There is no reason as to why this petition should subsist on Board considering that compliance affidavit has been filed by DDA stating that they have taken steps, by order dated 18th May 2023, to decide the representation of petitioner dated 26th July 2022. Basic remit of the order of dated 13th December 2022 passed by this Court in W.P.C. 16999/2022 of which compliance is sought, was for DDA to consider representation of petitioner and pass an appropriate order.

Moreover, what is important, as pointed out by Ms. Mrinalini Sen, SC for DDA, that the land on which the petitioner alleges encroachment, is land of DDA itself. However, she states that ownership had allegedly lapsed and they are challenging it under Writ Petition 879/2015. 3.
Petitioner claims that his is the neighbouring property and has a grievance related to easement.

This issue cannot be decided in a contempt petition and he has liberty to approach appropriate Court and seek his remedies available under law. 5.
