By way of present application filed under Section 438 read with Section 482 Cr.P.C., the petitioner/applicant seeks anticipatory bail in FIR No.247/2023 registered under Section 20 NDPS Act at P.S. Crime Branch. 3.
Learned APP for the State submits that in consequence of proceedings carried out under Section 82 Cr.P.C., the applicant has been declared proclaimed offender vide order dated 30.03.2024 passed by the Sessions Court. He has referred to the decision dated 14.03.2024 passed by the Supreme Court in Srikant Upadhyay v. The State of Bihar in SLP(Crl) No.7940 of 2023, to state that the present application is longer maintainable. 4.
Accordingly, the application is disposed of as infructuous alongwith the pending application.
