The present writ petition has been filed seeking direction to the respondent no.1 to release the vehicle of the petitioner bearing no.DL-1RM0711, which has been seized by the respondent no.1/ Transport Department, GNCTD vide seizure memo dated 13th March, 2026, being an 'End of Life' vehicle.

Counsel for the petitioner submits that an undertaking has been filed on behalf of the petitioner stating that, if the vehicle is released, it will not be plied in Delhi or parked on any public area/ road in Delhi. 3.

Counsel appearing on behalf of the respondent no.1/ Transport Department, GNCTD, on instructions submits that the vehicle is yet to be scrapped.

Accordingly, the present writ petition is disposed of in terms of the following directions:

i.

The petitioner shall apply for release of his vehicle in terms of the "Guidelines for Handling End of Life Vehicles in Public Places of Delhi, 2024" dated 20th February, 2024, read with "Standard Operating Procedure" (SOP) for Releasing End of Life Vehicle (ELV) Seized as Part of Enforcement Drive as per paras 6 & 7 of the "Guidelines for Handling End of Life Vehicle in Public Places of Delhi, 2024" dated 21st October, 2024. ii.

The petitioner shall approach the respondents along with all the requisite documents, including the undertaking that the petitioner shall not ply the vehicle within the limits of NCR of Delhi and shall not park the same in any public area within the NCR of Delhi.

iii.

The petitioner shall also pay the requisite penalty charges and towing charges. Since the petitioner had made an application for release of vehicle on 7th April, 2026, it is directed that parking charges shall be payable by the petitioner up to the said date only.

Upon the petitioner complying with the aforesaid requirements, the vehicle bearing no.DL-1RM-0711 shall be released to the petitioner. v.

The respondent no.2 shall not scrap the vehicle of the petitioner and shall preserve the same.
