The present bail application under Section 439 read with Section 482 of the Code of Criminal Procedure, 1973 („Cr.P.C.‟) has been filed on behalf of the petitioner for grant of interim bail for a period of 41 days in FIR bearing no. 198/2022, registered at Police Station Crime Branch, for offence punishable under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 („NDPS Act‟).

Issue notice. Learned ASC accepts notice on behalf of the State. 3.

This Court has heard learned counsel appearing on behalf of the petitioner and has perused the material placed on record. 4.

Learned counsel for the petitioner draws this Court‟s attention to the order of the learned Trial Court, specifically the last paragraph of the said order, wherein the learned Judge has noted, that Jail No. 3 has a centre for Senior Secondary Examination of National Institute of Open Learning; and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. has further directed the concerned Jail Superintendent to ensure that the accused appear in each and every examination, whether practical or theoretical, irrespective of the fact that the centre for his examination is inside or outside the Jail, and to make necessary arrangements in that regard. 5.

This Court finds no reason to interfere in the said order, however would reiterate that the concerned Jail Superintendent will abide by the order of the learned Trial Court, and will ensure that the petitioner herein will not miss his examination.

Directed accordingly.

At an oral prayer made by learned counsel for the petitioner, this Court also finds it appropriate to direct the concerned Jail Superintendent to ensure that the petitioner herein is provided with the study material, as is provided by the NIOS, for the relevant subjects. 8.

With the above directions, the present bail application is accordingly disposed of.
