By virtue of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of interim bail for a period of two months in the case arising out of FIR No.226/2022 dated 03.02.2022 registered at PS: Laxmi Nagar under Sections 302/149/120-B/34 of the Indian Penal Code, 1860 (IPC) and Sections 25/27 of the Arms Act, 1959 (AA) on the ground of the medical condition of his wife who requires surgical intervention for a dermoid cyst in her right ovary, which is slated for 04.06.2026/ 05.06.2026. 2.
Learned counsel for the applicant submits that, as recorded in earlier orders, due to the pending cross-examination of the eye-witness on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
20.05.2026 and 22.05.2026, the date earlier fixed for the surgery of the wife of the applicant was pushed ahead from 07.05.2026/ 08.05.2026 and is now fixed for 04.06.2026/ 05.06.2026. He further submits that since the wife of the applicant is also suffering from numerous other ailments and will require care and assistance by the applicant after the surgery, the applicant may be released on interim bail on humanitarian grounds. 3.
Pursuant to order dated 29.05.2026 passed by the Roster Bench, learned APP for State has handed over the medical verification report, which is taken on record, and whereby it has been verified that the surgery of the wife of the applicant for right ovarian dermoid cyst is indeed scheduled for 04.06.2026/ 05.06.2026 under the supervision of Dr. Vikas Yadav at Divya Multispecialty Hospital. Based thereon, learned APP submits that the applicant may be granted interim bail albeit for a reasonable period of time.

In view of the medical condition of the wife of the applicant and her upcoming surgery, which has since been verified by the State, in the interest of justice, the present application is allowed and the applicant is granted interim bail for a period of two weeks from the date of his release in proceedings arising out of FIR No. 226/2022 dated 03.02.2022 registered at PS: Laxmi Nagar under Sections 302/149/120-B/34 IPC and Sections 25/27 AA, subject to the following conditions:- (i) The applicant shall furnish a personal bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount, to the satisfaction of the concerned Jail Superintendent.

(ii) The applicant shall not leave NCT of Delhi without prior permission of the learned Trial Court and shall ordinarily reside at his address as per prison records.
(iii) The applicant shall also surrender his Passport, if any, to the concerned Jail Superintendent.
(iv) The applicant shall not contact/ visit/ offer any inducement/ threaten/ promise/ attempt to influence any of the prosecution witnesses or other persons acquainted with the facts of case. The applicant shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial.
(v) Upon expiry of the period of two weeks of interim bail from the date of his release, the applicant shall surrender before the concerned Jail Superintendent on or before 04:00 PM on the said date.

A copy of this order be sent to the concerned Jail Superintendent for information and compliance forthwith.
