The present writ petition has been filed seeking to restrain the respondents from carrying out demolition of the petitioner's hut in the property at T-Huts, Behind G-5, Near Moolchand Hospital, Lajpat Nagar III, New Delhi-110024 (hereinafter 'subject property'). 2.
Mr. Akshay Ringe, counsel appearing on behalf of the petitioner, submits that the aforesaid demolition action is being taken without issuance of a show cause notice. He submits that the petitioner, along with his family, has been residing in the said hut at the subject property for about 60 years. 3.
Mr. Sagar Kumar, counsel appearing on behalf of the respondentMCD, submits that no notice is required to be given as the petitioner is an unauthorized encroacher on Government land.

the petitioner has been in occupation of the subject property for a long period of time, four (4) months' time is given to the petitioner to vacate the subject property and find alternative accommodation. 5.
No coercive steps shall be taken by the respondent-MCD for a period of four (4) months from today.

However, in the event the petitioner fails to vacate the subject property within four (4) months from today, the respondent-MCD shall be free to take appropriate action in accordance with law. 7.
The writ petition stands disposed of in terms of the above. 8.
Pending applications stand disposed of.
