The present writ petition has been filed seeking an order restraining the respondent-MCD from taking coercive action in pursuance to the vacation notice dated 8th April, 2026, and the demolition order dated 18th August, 2025, in relation to Third Floor of the property bearing no. 809-B, 3rd Floor, Chirag Delhi-110017 (hereinafter the 'subject property'). 2.

It is submitted that an appeal has been filed by the petitioner against the demolition order dated 18th August, 2025 before the Appellate Tribunal, MCD (hereinafter the 'ATMCD').

Notice in the interim application as well as the appeal has been issued on 15th April, 2026 and the matter is now to come up before the ATMCD on 12th May, 2026 for arguments on the interim application. 4.

In view thereof, the present petition, along with all pending applications, stands disposed of, while restraining the respondent-MCD from taking any coercive steps in pursuance of the demolition order dated 18th August, 2025 and/ or the vacation notice dated 8th April, 2026, till the time the interim application filed by the petitioner is decided by the ATMCD.

Needless to state, ATMCD shall decide the interim application in an expeditious manner, on its own merits, without being influenced by the order passed by this Court today.
