% 11.07.2017 It is submitted by the learned counsel for the Plaintiff that the matter stands settled vide settlement deed dated 16.05.2017 before the Mediation Cell wherein the Defendant has to pay a sum of Rs.21 Lakhs to the Plaintiff in full and final settlement of all claims. As per this settlement, the Defendant shall withdraw the counter claim filed against the Plaintiff and the Plaintiff shall withdraw the Suit. Since payment of Rs.21 Lakhs has been made in terms of the settlement, the counter claim stands withdrawn as also the present Suit for recovery of Rs.1,54,41,500/-. The decree sheet be prepared accordingly. As per Section 16A of the Court Fees Act, 1870, since the matter is settled in the Mediation, the court fees be refunded to the Plaintiff as well as the Defendant as per law.
