% 28.08.2020 Hearing has been conducted through Video Conferencing. Ms. Bengani learned counsel for the Petitioners, submits that she has instructions to withdraw the present petition. She further submits that in view of the decision taken by the Respondents, which is also recorded in the order dated 22.07.2020, that the Petitioners shall be liable to pay the Licence Fee, only from the date the Inter-State Bus Operations resume at the concerned ISBTs, prayer (a) should be allowed and the letters dated 20.05.2020 whereby petitioners were asked to take possession of their shops/kiosks be quashed.
In the order dated 22.07.2020 Court has recorded the decision taken by the Board of the Respondents, in the peculiar and unprecedented prevailing circumstances, on account of pandemic COVID-19, whereby Petitioners shall be given possession as well charged the Licence Fee, only from the date of resumption of the Inter-State Bus operations, at the
respective ISBTs.
In view of the above, Petition is disposed of as withdrawn. Impugned letters dated 20.05.2020, shall not be given effect to, in terms of the decision of the Board.
