% 10.04.2019 Learned counsel for the petitioner submitted that he does not want to lead the evidence before the Trial Court in the application filed under Section 145 (2) and only intends to cross-examine the petitioner and does not intend to cross-examine his witnesses. Learned counsel for the petitioner, after some arguments, further submitted that he may be allowed to withdraw the present petition with the direction to the Trial Court to decide the matter expeditiously. The statement of the petitioner is taken on record that he does not want to lead evidence on his behalf and shall only cross-examine the petitioner. Accordingly, the petition is dismissed as withdraw with the direction to the Trial Court to decide the matter expeditiously preferably within one year. Pending applications also stand dismissed as withdrawn. The cost imposed upon the petitioner is reduced to Rs.5,000/-.
