% 03.02.2017 The petitioner has filed the present petition seeking adjudication of a pure question of law.

It is contended by the learned counsel for the petitioner that the dicta laid down by this Court in Prem Cashew Industries and Ors. vs. Zen Pereo: 88 (2000) DLT 59 is not being followed by the Metropolitan Magistrates. Learned counsel for the petitioner fairly concedes that the petitioner seeks adjudication of a pure question of law and this petition is not concerned with the factual matrix of any case. Learned counsel for the petitioner prays for leave to withdraw the petition with liberty to raise the question of law in an appropriate case. The writ petition is, accordingly, dismissed as withdrawn with liberty as prayed for.
