O R D E R

% 16.05.2019 This petition challenges the order dated 15.01.2019 whereby an application under Section 66(2) of the Evidence Act filed by petitioner was dismissed. In the application the petitioner had demanded the copy of registered Will of Late Sh.Surender Dev on the basis of which the subject property was transferred in favour of defendant No.2 vide Conveyance Deed dated 17.08.2017. The petitioner in fact wished to amend his suit and seek declaration and cancellation of conveyance deed.

It is submitted by learned counsel for the respondent present here that already an application under Order 11 Rule 14 CPC has been moved by the petitioner seeking disclosure and providing of valuable information by the petitioner herein qua the registered Will as also qua details of the conveyance deed dated 17.08.2018 and the

respondent has to file a reply to the said application before the trial court on 20th May, 2019. Considering these facts there is no use to continue with this petition since the respondent would file a reply to the interrogatories qua the information/details of the documents demanded by the plaintiff herein.

With these observations the petition is disposed of. Pending application also stand disposed of.
