Dr. Amit George, learned counsel for the decree holder, states that the award under enforcement, dated 10.12.2019, was partially set aside by a judgment dated 23.02.2022 in O.M.P.(COMM.) 432/2020. The decree holder has filed an appeal [FAO(OS)(COMM.) 163/2022] against the judgment dated 23.02.2022, which remains pending before the Division Bench.

Dr. George states that part of the award which has been sustained by the Court, has already been satisfied.

The enforcement proceedings are therefore disposed of with liberty to the decree holder to apply for revival of the proceedings in the event it is successful in its appeal.
