O R D E R

Through the present writ petition, the Petitioner prays as under : "(i) Issue a Writ of Certiorari for Quashing of the order dated 26.03.2025 whereby the Legal Notice Dated 14.03.2024 preferred by the Petitioner seeking fixation of seniority in the rank of Assistant Commandant is Rejected; and (ii) Issue a Writ of Mandamus directing the Respondents to consider and grant out of Tum Promotion to the Petitioner to the rank of Assistant Commandant w.e.f. year 2002 based on her medal (Gold) winning performance in 14th Asian Games as has been done in case of similarly situated personnel in line with the judgment dated 20.04.2015 passed by this Hon'ble Court in W.P (C) No. 7043/2012 titled as Pradeep Singh and Anr. Vs. Union of India through it's Secretary and Ors., in view of the policy dated 14.07.1998 and OM dated 26.07.

2012, including fixation of pay along with increments and back wages, with all consequential benefits; and (iii) Issue a Writ of Mandamus directing the Respondents to refix her seniority along with her batchmates i.e. w.e.f. 2002; and (iii) Pass any such orders as the Hon'ble Court may deem fit in the light of above mentioned facts and circumstances of the case."

The Petitioner essentially claims promotion as Assistant Commandant from the year 2002.

Pertinently, the present petition has only been filed by the Petitioner in the year 2026, that is, after a period of nearly 24 years from the date from which the Petitioner claims promotion. 4.

Undisputedly, the Petitioner was promoted as Assistant Commandant on 18.12.2008. Thereafter, she was promoted as Deputy Commandant on 10.03.2016.

The representation filed by the Petitioner has already been rejected on the ground of delay and latches while relying upon the judgment passed in W.P.(C) 9606/2020, which was decided on 01.12.2020.

Learned counsel representing the Petitioner submits that the Petitioner is a sportsperson and an achiever, hence, the Court should ignore the delay.

Having considered the submission, this Court is left with no choice but to expresses its inability to accept the said explanation, especially since despite having been promoted as Assistant Commandant on 18.12.2008, the Petitioner never made any representation within a reasonable time.

Hence, the present writ petition is dismissed only on the ground of delay and latches.
