This petition has been filed alleging wilful disobedience of order dated 9th October 2024, 13th January 2025, and 27th February 2025, passed by the Civil Judge in CS SCJ 1050/2022. The issue concerns the challenge on the maintainability of the suit by defendant nos.1 & 2 in the proceeding, on the basis that they had initiated proceedings under Section 15 of the Public Premises Act, 1971 qua Property no. 22/1, Prem Nagar, Jail Road, Delhi.

On 9th October 2024, the Civil Judge stated that it was clarified that failing compliance to file these documents by defendant nos. 1 & 2, their right to argue on maintainability and defense shall be struck off. 3.

Subsequent orders were passed on the basis of the continued inability of the defendant nos.1 & 2 (respondent no.2 herein) to produce the said documents relating to the initiation of proceedings under the Public The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Counsel for respondent no.2 is present in Court and states that he has no confirmation whether the said proceedings were initiated and that the said documents have not been filed before the Civil Judge. 5.

In this light of the matter, the Civil Judge may take further steps in accordance with the directions passed by the Court itself on 9th October 2024, and on subsequent dates.

The Court clarifies that it has not passed any observation on the merits of the matter and it is for the Civil Judge to take steps in accordance with law.

Since counsel for respondent states that they have no instructions in the matter, the concerned official of respondent no.2 shall be present before the Civil Judge on 7th April 2025, the date when the matter is fixed, to provide proper and verified information/documents in the matter. 8.

Accordingly, the petition is disposed of with the aforesaid directions. 9.
