The present petition has been filed by the petitioners praying inter alia that they be permitted to resume the Weekly Bazaar (Som Bazaar) at Shalimar Bagh, as before, i.e., prior to the onset of the COVID-19 pandemic, that resulted in a lockdown declared by the Central and the State Government.

Mr. Wadhwa, learned counsel for the petitioners states that a similar order was passed by DB-I on 04.06.2020, in W.P.(C) 3349/2020. We have enquired from learned counsel for the petitioners as to what was the scope of the aforesaid petition particularly since he was the counsel in the said matter as well. Learned counsel states that the aforesaid petition was in the nature of a Public Interest Litigation and the relief in the said petition was for permission to run weekly bazaars all over Delhi. W.P.(C) 3556/2020

If that is the position, then we see no reason to entertain the present petition, which is only confined to a particular locality, i.e., Shalimar Bagh, as directions have already been issued to the respondents in the captioned petition to consider the representation of the petitioner therein in accordance with the applicable rules, regulations and policy etc. Therefore, we do not propose to duplicate the said order.

The present petition is accordingly disposed of with directions issued to the respondent No.2/GNCTD to consider the representation dated 06.06.2020 (Annexure P-5) submitted by the petitioners herein and decide the same within two weeks, under written intimation to learned counsel for the petitioners.

The present petition is disposed of in terms of the aforesaid order alongwith the pending application.
