CRL.M.A. 7647/2019 (for condonation of delay) In view of the cause submitted in the application, the delay in re-filing the petition is condoned. Application stands disposed of. CRL.REV.P. 425/2019 & CRL.M.A.7625/2019 (for stay) 1.

Learned counsel for the petitioner, at the outset, submitted that the petitioner is having one wife and two sons who are dependent on him and also has to pay rent for the accommodation, and hence, the interim maintenance amount fixed by the Trial Court @ Rs.3,000/- per month each for the parents of the petitioner is exorbitant. However, the learned counsel for the petitioner, after some arguments,

submitted that he may be allowed to withdraw the present petition with the direction to the Trial Court to expedite the proceedings and if the amount of interim maintenance granted by the Trial Court is found to be excessive, the same may be adjusted from the final maintenance amount. Accordingly, the petition is dismissed as withdrawn with the direction to the Trial Court to decide the matter expeditiously. Pending application is also dismissed as withdrawn. It is also directed that if the amount of interim maintenance granted by the Trial Court is found to be excessive, the same may be adjusted from the final maintenance amount.

Further, it is submitted by the learned counsel for the petitioner that the petitioner may be given some time to clear the arrears. The petitioner may move an appropriate application before the Trial Court which may be decided as per law.
