At the outset, Mr. Anupam Srivastava, learned ASC appearing on behalf of the Respondents states that Village Dera Mandi, Tehsil Mehrauli has since been urbanised vide notification dated 20.11.2019. Copy of said notification has been handed over in Court and taken on record. Therefore, the Revenue Officials cease to have jurisdiction with respect to Khasra No. 750/5, 750/6, 780/7, 750/8 and 750/9, Abadi Lal Dora, Gaon Dera Mandi, situated in Revenue Village of Dera Mandi, Tehsil Mehrauli, New Delhi. He further submits that the apprehension of the Petitioner that his land has been encroached is unfounded since the kutcha road has been constructed on the Delhi Development Authority (DDA) land and there is no encroachment on Petitioner's land as the position exists today sans demarcation. Photographs to substantiate this position are handed over to the Court and to the Petitioner who is also present in Court.

At this stage, learned counsel for the Petitioner, on instructions, seeks to withdraw this petition with liberty to file a representation with DDA for demarcation of the subject land.

This petition is accordingly disposed of as withdrawn leaving it open to the Petitioner to represent to the DDA seeking demarcation and as and when the representation is received, the same shall be decided in accordance with law, within six weeks from the date of receipt of the representation. Decision shall be communicated to the Petitioner within one week and it is open to the Petitioner to take recourse to appropriate remedies in law, in case of any surviving grievance.

Pending applications also stand disposed of.
