% 10.01.2017 C.M. Appl. No. 19792/2016 (U/O 21 Rules 10 and 11 CPC, moved on behalf of R- 5 and 10) In my opinion, this application is not maintainable because if a final judgment in a writ petition is not complied with, a contempt petition was an appropriate remedy.
Counsel for the petitioner states that the contempt petition was filed, being Contempt Case (C) No. 837/2015, but the same was dismissed as withdrawn to file appropriate proceedings. Appropriate proceedings cannot be by means of filing an application in the nature of execution in a disposed of case because the Court is functus officio after passing of the final judgment.

In spite of the above, no orders are required in this application, inasmuch as, counsel for the respondent/JNU states that the judgment of this Court dated 22.11.2013 is in the process of being complied with by the respondents and the needful will be done within two weeks from today.
