% 14.02.2020 By way of the present petition, the petitioner seeks furlough for a period of two weeks.
The application for furlough was rejected by the competent authority on 26.11.2019 observing that whenever the petitioner comes out on furlough, he tortures and threaten his wife. It is submitted by the learned counsel for the petitioner that last time when the petitioner availed furlough from 21.06.2019 to 05.07.2019, he stayed at his sister home at H.No.-08, Gali No.-2, (Near New Pipe Line), Opposite Kanch Godam, Sonu City, Kabool Nagar Behta Hazipur, Distt.- Ghaziabad, UP, PS-Loni, U.P. with his sister's family.
State has filed its status report and nothing adverse has been come against the petitioner in the status report, except the statement of his wife.
So in these circumstances, the petitioner is directed to be released on furlough for a period of two weeks, on his furnishing a personal bond in sum of Rs. 20,000/- with one surety of like amount to the satisfaction of the jail superintendent. However, he shall not in any manner contact his wife and shall not visit her house during this period. The petition is disposed of.
A copy of this order shall be transmitted to the concerned Jail Superintendent.
