This writ petition seeks a direction to the Respondents to convene a Departmental Promotion Committee1 for the post of Vice Principal in the Respondent School.

The limited grievance of the Petitioner is that he is eligible for promotion to the post of Vice Principal from the date the vacancy arose, i.e., 1st August, 2025, and that he has been officiating as Vice Principal since the said date. It is submitted that the right to be considered for promotion is a facet of Article 16 of the Constitution of India. 3.

It is further contended that the delay in convening the DPC is adversely affecting the Petitioner's career progression and is in violation of Rules 96 and 109 of the Delhi School Education Rules, 1973, which govern 1 "DPC"

promotions in recognised aided schools on the basis of seniority and eligibility, both of which the Petitioner claims to satisfy. 4.

It is further noted that the Petitioner's representation dated 4th April, 2026, raising the aforesaid grievance, is presently pending consideration before the Directorate of Education.2 5.

At this stage, since no decision has been taken on the said representation and considering that the Petitioner's grievance warrants examination, the Court considers it appropriate to direct the DoE to take a decision thereon in a time-bound manner.

Accordingly, without entering into the merits of the rival contentions, the DoE is directed to consider and decide the Petitioner's representation dated 4th April, 2026 within a period of six weeks from today. In the event the Petitioner is found eligible, the DPC shall be convened in accordance with law.

In case it is concluded that the Petitioner is not entitled to promotion, a reasoned order shall be passed by the DoE. The Petitioner shall be at liberty to avail appropriate remedies in accordance with law. 8.
