This application has been moved on behalf of the appellant/ NHAI seeking withdrawal of the appeal in the backdrop of the settlement arrived at between the parties under the Vivad se Vishwas II (Contractual Disputes) scheme.

In support of this assertion, office memorandum dated 29.05.2023 exhibited as Annexure-I along with the application has been placed on record.

Dr Amit George, learned counsel, who appears on behalf of the nonapplicant/ respondent says that he would have no objection if the prayer made in the application is allowed.

Accordingly, the prayer made in the application is allowed. 3.1.

Consequently, the appeal is dismissed as withdrawn. FAO(OS) (COMM) 100/2023 4.

In view of the order passed in CM APPL. 31856/2024, nothing further needs to be done.

The case papers shall stand consigned to the record. 6.

The date already fixed in the matter i.e., 09.07.2024, shall stand cancelled.
