By this application, petitioner seeks extension of interim bail granted to him vide order dated 20th March, 2020 in case FIR No.219/2017 under Sections 302/201/34 IPC registered at PS New Friends Colony, New Delhi. BAIL APPLN. 1286/2020

Vide order dated 20th March, 2020 the petitioner was granted interim bail on the ground of surgery of his wife and to get his children admitted in the school. The surgery of the wife of the petitioner has not been performed till date. The said interim bail was granted for a period of four weeks subject to certain conditions. Thereafter the petitioner applied for extension of bail which application was dismissed by this Court vide order dated 22nd May, 2020. Despite there being no specific order of extension as the interim bail was granted for a purpose and also this Court declining to extend the interim bail of the petitioner vide order dated 22nd May, 2020 grating him the liberty to seek interim bail as and when a definite date for the surgery is fixed, the petitioner has not surrendered to custody till date. 3.

Considering the conduct of the petitioner in not surrendering to custody despite the decline of interim bail vide order dated 22nd May, 2020, this Court finds no ground to grant interim bail to the petitioner or extend the same.

Petition is dismissed.
