The present Petition has been filed on behalf of the Petitioner under Section 115 of the Code of Civil Procedure, 1908 [hereinafter referred to as "CPC"] against the order dated 03.02.2025 passed by learned District Judge5, Patiala House Courts, New Delhi [hereinafter referred to as "Impugned Order"]. By the Impugned Order, the Application under Order VI Rule 17, CPC filed by the Petitioner/Plaintiff has been dismissed. 2.

After some arguments, learned Counsel for the Petitioner seeks and is granted permission to withdraw the present Petition with liberty to take appropriate remedies.

The Petition is accordingly dismissed as withdrawn with liberty as sought for in accordance with law. Pending Application shall stand closed. 4.
