W.P.(C) 3574/2020 & C.M. APPL. 12715/2020 Hearing has been conducted through Video Conferencing. Petitioner herein is a Senior Officer in the rank of the Additional Secretary to the Government of India and working at present as Senior Chief

Medical Officer in CGHS.

Present petition has been filed seeking stay of the inquiry initiated by the Internal Complaints Committee. Petitioner, as averred in the petition, has already approached the Central Administrative Tribunal and the Original Application is pending.

In view of judgment in L. Chandra Kumar vs. Union of India, (1997) 3 SCC 261, read with Section 14 of the Administrative Tribunals Act, 1985, this Court has no jurisdiction to deal with the present petition. Mr. Malhotra, learned counsel for the Petitioner fairly submits that he has instructions to withdraw the petition, with liberty to approach the Central Administrative Tribunal.

Petition along with accompanying application is accordingly disposed of with the liberty, as aforesaid.
