O R D E R

% 25.01.2018 It is submitted that petitioners and respondent no.2 are neighbours. Some property disputes between them had led to registration of FIR No. 83/2016 under Sections 452/380/342/354/506/34 IPC at police station Ambedkar Nagar, on the complaint of respondent no.2. Husband of the respondent no.2, namely Sh. Narayan Singh filed a civil suit against the petitioner no.2. The said proceedings were referred to the Delhi Mediation Centre, Saket Court where matter has been settled between the parties. Present petitioners and respondent no.2 have also signed the proceedings before the Mediation Centre. A copy of the proceedings of the Mediation Centre has been annexed with this petition as Annexure-C. Petitioners have paid `2.75 to the respondent no.2 towards the balance settled amount through a demand draft,

photocopy whereof has been placed on record. Respondent no.2 submits that entire settled amount of `4.75 lacs stands paid with this payment. Sh. Narayan Singh-husband of the respondent no.2 is present in Court and confirms the receipt of entire settled amount including the payment made today in Court. Respondent no.2 and her husband submit that they shall hand over the property papers, in terms of the settlement, to the petitioners on 31st January, 2018 before the trial court in a Civil Suit No. 20945/2016 tilted Narayan Singh vs. Ram Pal. Their joint statement, on oath, in this regard has also been recorded separately. Respondent no.2 submits that she has no objection in case the FIR is quashed.

Keeping in view of the settlement arrived at between the petitioners and respondent no.2 before the Mediation Centre voluntarily, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
