% 16.07.2020 Hearing has been conducted through Video Conferencing. This is an Application under Section 439 read with Section 482 Cr.PC for grant of Interim Bail in case FIR No.116/2018, under Sections 302/34 IPC and Sections 25/27 Arms Act, registered at PS Mandir Marg, for a period of 45 days due to Pandemic Covid-19, seeking the benefit of the Resolution dated 18.05.2020 of the High Powered Committee. Status Report has been filed by learned Additional Public Prosecutor. It is stated that the allegations are serious. Applicant does not meet the criteria for interim bail as per the recommendations of the Committee, as he has not completed 2 years as an Under Trial Prisoner, for the offence charged under Section 302 IPC.
Status Report with respect to Covid-19 in the concerned Jail, has been received from the Jail. It is stated that Applicant is in Central Jail No.4, Tihar Jail and so far no prisoner has been tested COVID-19 positive in the said jail.
Mr. Manoj Singh, learned counsel for the Applicant submits that he has received both the Status Reports. Having gone through Status Reports,
learned counsel seeks to withdraw the bail application with liberty to file afresh as and when the Applicant meets the criteria laid down by High Powered Committee or on arising of fresh cause. Bail Application is disposed of as withdrawn, granting liberty, as prayed for.
