The Application filed by the Plaintiff under Order 23 Rules 1 and 3 read with Section 151 of the Code of Civil Procedure, 1908 ('CPC'). 2.

It is submitted by the learned Counsel for the Plaintiff that during the pendency of the present Suit, the Parties have settled the dispute and entered into Settlement Agreement, containing the terms of settlement. 3.

By way of the present Application, the Plaintiff seeks disposal of the present proceedings on the following terms:

(i) The Parties have entered into a Settlement Agreement providing the terms and the time duration for the Worldwide Patent Licence. (ii) The Defendant has agreed to withdraw the Counter-Claim and the Revocation Petitions instituted by the Defendant, which are as under: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. a) CO COMM NO. (IPD-PAT) 7/2024 has been filed against the patent IN322739, b) CO COMM NO. (IPD-PAT) 9/2024 has been filed against the patent IN405869, c) CO COMM NO. (IPD-PAT) 12/2024 has been filed against the patent IN478573, d) CO COMM NO. (IPD-PAT) 13/2024 has been filed against the patent IN301675, e) CO COMM NO. (IPD-PAT) 13/2025 has been filed against the patent IN398908.

(iii) The Parties have agreed to withdraw all the proceedings filed against each other and the same shall not be enforced against each other in view of the Worldwide Patent Licence and the Settlement Agreement entered into between the Parties.

In view of the above, the Revocation Petitions, being CO COMM NO. (IPD-PAT) 7/2024, CO COMM NO. (IPD-PAT) 9/2024, CO COMM NO. (IPD-PAT) 12/2024, CO COMM NO. (IPD-PAT) 13/2024 and CO COMM NO. (IPD-PAT) 13/2025, are hereby withdrawn with immediate effect. 5.

The Application stands disposed of.

The present Suit is disposed of in terms of order passed above in I.A. No. 16916/2025. The Parties are bound by the Terms of the Settlement. 7.
