The hearing was conducted through video conferencing. 2.

Petitioner has filed the present petition contending that respondent is not coming forward for complying with his agreed terms of the settlement.

Learned counsel for the respondent, who appears on advance notice, submits that respondent is still willing to abide by the terms and conditions of the settlement. However, he is presently in the United Kingdom and is not in a position to come to India to execute the remaining settlement terms. He submits that as and when the CONT.CAS(C) 307/2020

flights connection is resumed, he shall come to India to perform his part of obligations.

Learned counsel for the petitioner submits that in view of the assurance given by the learned counsel for the respondent, he does not press his petition at this stage and seeks leave to withdraw the petition.

Petition is, accordingly, dismissed as withdrawn. 6.
