The present writ petition has been filed seeking directions to the respondent no. 1 to take action with respect to unauthorized construction being raised at property No. 6015-6017, Block No. 3-B, Dev Nagar, Karol Bagh.

Learned counsel appearing for the respondent-MCD on advance notice hands over to this Court, a copy of the document to show that there is a sanctioned building plan in favour of the owner/occupant of the property in question, i.e., respondent no. 4.

notice, submits that the construction being undertaken by the respondent no.4 in the property in question, is in terms of the sanctioned building plan. He has further produced before this Court, a letter of 'No Objection' from the owners/occupants of the adjacent properties. 4.

Per contra, learned counsel appearing for the petitioner submits that even if the construction is being carried out on the basis of a sanctioned building plan, there are deviations.

Accordingly, the MCD is directed to inspect the property in question. In case, there are any deviations from the sanctioned building plan, the owner/occupant of the property in question shall be directed to rectify the said deviations. In case, the said deviations are not rectified by the owner/occupant of the property in question, then, the requisite actions shall be taken by the MCD.
