The present petition has been filed by the petitioner being aggrieved by the inaction on the part of the Department of Health and Family Welfare, Government of NCT of Delhi (respondents) in not releasing the requisite payment due to the petitioner for supply of 42,00,000 (forty two lakhs) Rapid Antigen Test Kits for Novel Corona Virus (SARS-COV-2/COVID19) under Contract No. GEMC-511687764629287 dated 27.12.2021. 2.

The said contract was awarded to the petitioner pursuant to being declared as the L1 Bidder in an online bidding process. Pursuant to the award of the contract the petitioner supplied a total number of 27,81,875 (twenty seven lakhs eighty one thousand eight hundred and seventy five only) test kits from 28.12.2021 to 09.05.2022 which were duly received by the respondents for the total value of Rs. 1,54,85,029/- (Rupees one crore fifty four lakhs eighty five thousand and twenty nine only). 3.

However, it is submitted that despite the factum of supply not being disputed, and without any deficiency being found in the supplies made by The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the petitioner, no amount whatsoever has been released by the respondents to the petitioner.

Vide order dated 03.04.2025, while issuing notice, the concerned Officer of Department of Health and Family Welfare, GNCTD was also directed to join the proceedings virtually on the next date of hearing. Consequently, Dr. Nalini Bala Pandey (Head of Office-DGHS) has appeared today.

After some hearing, it is submitted by the concerned Officer that the supplies made by the petitioner to the respondents shall be duly verified and if any payment is found due and payable to the petitioner, the same shall be duly paid.

Let the aforesaid exercise of verification of the supplies made by the petitioner be carried out interactively by the concerned representative of the respondents, along with a representative of the petitioner. Let the same be done within a period of six weeks from today. 7.

Let requisite payment, if any, as may be found due and payable to the petitioner be duly paid to the petitioner.

The present petition is disposed of in the above terms. 9.

Needless to say, if the petitioner is aggrieved by the above exercise, he shall be at liberty to avail appropriate remedies under law.
