O R D E R

% 13.07.2020 (hearing through Video Conferencing) In terms of the proceedings dated 2.7.2020, learned counsel for the applicant submits that in view of the present pandemic the District Courts are not functioning and the petitioner has been unable to place on record copy of the examination-in-chief of PW-4.

On behalf of the State, reliance has been placed on the verdicts of this Court in Jasbir Singh Sodhi V. Union of India & Ors.; in W.P.(Crl) 1481/2009, a verdict dated 7.1.2010 and on the verdict of this Court in Azharudin @ Ajru @ Kadwa V. State; Bail Appln. No. 1299/2020, order dated 3.7.2020 to submit that the applicant ought to have first sought the redressal before the learned Trial Court to seek redressal for the grant of regular bail before seeking the said prayer before this Court despite concurrent jurisdiction that may be exercised by this Court. Learned counsel for the petitioner seeks to withdraw the present

petition submitting to the effect that he would seek redressal before the learned Trial Court and that he may be granted liberty to seek redressal in accordance with law subsequently, if so required, to grant of which prayer there is no opposition on behalf of the State In view thereof, the Bail Appln. No. 1297/2020 filed by the applicant/petitioner is thus dismissed as withdrawn with liberty granted as prayed to the applicant to seek redressal before the learned Trial Court in accordance with law, if so required.
