Mr. Ashish Singh, learned counsel for the petitioner submits that the matter was referred to mediation, but the mediation has failed, though the representative of the respondent/bank had appeared in the mediation. 2.

He submits that the only grievance of the petitioner is that the petitioner wants to settle the matter, and he has also made various representations which have not been responded to by the respondent bank. 3.

This Court is of the view that the present petition is not maintainable under Article 226 of the Constitution of India. 4.

Faced with this situation, the petitioner seeks to withdraw the present petition with liberty to approach the bank with an OTS proposal. 5.

In the event any proposal is made by the petitioner, the respondent bank is directed to consider the same within a period of 04 weeks in accordance with its guidelines.

The petition along with pending application is disposed of in the above terms.
