Petitioner seeks interim bail in FIR No.115/2017 under Section 302 of IPC, Police Station Dwarka South.

Subject said FIR was registered on a DD Entry that there was a fight which had taken place. When the police party reached the spot deceased was found. Petitioner and the other two co-accused are alleged to have murdered the deceased. The allegations against the coaccused are that they used Chapad (butcher knife) and petitioner has been alleged to have used a hammer.

Learned counsel for petitioner submits that the role ascribed to all the three accused is identical and that the other co-accused had been granted interim bail and they have duly surrendered. BAIL APPLN. 940/2019

Interim bail is sought on the ground of marriage of the cousin sister i.e. the daughter of the sister of the father of the deceased. It is alleged that she does not have a real brother and the relation between her and petitioner has always been that of a brother and sister, as they were living in a joint family.

Learned counsel further submits that three of the public witnesses have already been examined. The factum of marriage has been verified and it is scheduled to be held on 13th and 14th April, 2019.

On petitioner furnishing a bail-bond in the sum of rupees one lac with one local surety of the like amount to the satisfaction of the trial court/CMM/Duty Magistrate, petitioner shall be released on interim bail for a period of five days from his release. Petitioner shall not do anything which may prejudice the trial or the prosecution witness. Petitioner shall also not leave the country without the prior permission of the trial court. Petitioner shall surrender to the concerned Superintendent Jail on expiry of five days from the date of his release.

The bail application is disposed of.
