1. The hearing was conducted through video conferencing.
2. The petitioner seeks anticipatory bail in case FIR No. 90/2020 under section 6 of POCSO Act, 2012 and 506, IPC registered at Police Station-Dwarka South on the basis of a complaint filed by her brother-in-law i.e. her husband's elder brother, apropos certain allegations made against her. It is the petitioner's case that this is nothing but a way of getting back at her, in view of the complaint filed by her apropos sexual assault committed on her minor daughter, by the minor son of her aforementioned brother-in-law. Pursuant to her complaint, the son was sent to an Observation Home.
3. The petitioner has deep roots in society. She claims that her 8-yearold daughter needs her constant physical presence and regular emotional and psychological support, especially in the current delicate situation when the said assaulted minor is going through her own fears and emotional trauma. Their problems are compounded by the
COVID-19 pandemic constraints, when the need to be ever so vigilant for one's health and safety is so stark. The petitioner is ready and willing to join investigations as and when required by the Investigating Officer. Let her do so. However, because of the prevailing COVID-19 pandemic circumstances, due precautionary measures and medical advisory/protocol shall be adhered to, to ensure the safety of all parties. In the event of arrest, the petitioner shall be released on her furnishing a personal bond in the sum of Rs.15,000/- with one surety of the like amount, to the satisfaction of the IO.
4. The application is disposed-off in terms of the above.
5. Nothing stated in this order shall be deemed to be an adjudication on the merits of the case. The order be uploaded on the website forthwith. Copy of the order be also forwarded to the counsels through email.
