The present application has been filed on behalf of the petitioner seeking interim bail in FIR No.254/2018, registered under Sections 307/341/34 IPC at Police Station Anand Parbat, Delhi on the ground that the petitioner's brother, who is paralyzed and living with his unmarried sister, requires medical care and attention.

Learned counsel for the petitioner submits that the co-accused, namely, Manish@ Kalia has already been released on regular bail He further submits that the petitioner is in custody since 25.04.2019. He further submits that during the period of his release, the petitioner shall stay at House No.9784, Third Floor, Ahata Thakur Dass Gali, near Sarai Rohilla Railway Station, Sarai Rohilla, Delhi.

A Status Report has been placed on record by the State wherein it has been stated that the petitioner's parents and one brother, namely, Bhupender have expired. It has been further stated that the petitioner's elder brother, namely, Bharat Bhushan, is staying with his unmarried sister, namely, Kavita. The other two sisters are stated to be living in their matrimonial homes. It is further stated that the sons of the petitioner's brother are living separately along with their mother and are aged 5 & 14 years. It is also stated in the Status Report that the petitioner is not involved in any other case.

I have heard the learned counsel for the petitioner as also the learned APP for the State and have perused the case records. 5.

In view of the fact that the petitioner's brother is paralyzed and needs medical care and attention, the petitioner is admitted to interim bail for a period of one week from the date of his release, on his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/Duty M.M. subject to the following further conditions:- (i) The petitioner shall report to SI Amit Prajapati every day on his mobile number 9711223708.

(ii) The petitioner will not leave NCT of Delhi without prior permission of the concerned Court.

(iii) The petitioner shall not directly or indirectly get in touch with the complainant or any other prosecution witness and shall not try to tamper with the prosecution evidence.

(iv) At the expiry of the interim bail period, the petitioner shall surrender before the concerned Jail Superintendent.

The application stands disposed of accordingly. 6.

A copy of this order be communicated to the concerned Jail for information and necessary compliance.
