Appeal under Section 96 read with Ordre XLI Rules 1 and 2 of CPC has been filed on behalf of the Appellant for setting aside impugned Judgment dated 19.01.2026 passed in CS No.19/2025 under Order XII Rule 6 of CPC, whereby Suit of the Plaintiffs / Respondents for Possession in respect of the Suit Property bearing No.B-1/17, 1st Floor, Vasant Vihar, Delhi with half terrace rights along with one car parking in driveway and one servant quarter with common WC on terrace measuring 600 sq. yards, has been decreed in their favour.

Learned counsel for the Appellants, on instructions, submits that Appellants are not contesting the Appeal on merits and undertake to vacate the Suit Premises within 60 days from today.

Learned counsel for the Respondents has no objection to granting 60 days' time to the Appellants to vacate the Suit Premises. 4.

Applications is disposed of with directions to the Appellants to handover vacant and peaceful possession of the Suit Property to the Respondents within 60 days from today.

Needless to say that this Order does not, in any way, impedes the Plaintiffs / Respondents from continuing with their Suit for Recovery of Mesne Profits, which is pending before learned Trial Court and this period would not, in any way, be exempted from the payment of rent/mesne profits.
