The learned counsel for the petitioner submits that the issue as raised in the present petition is pending consideration before the Hon'ble Supreme Court. He seeks liberty to withdraw the present petition and file afresh after the issue is decided by the Hon'ble Apex Court.

He further seeks liberty to file an application seeking bail on its own merits before the learned Trial Court. 3.

The petition is dismissed as withdrawn.
