% 22.01.2024 I.A. 1502/2024 (for withdrawal of petition) & O.M.P. (COMM) 183/2023 An application i.e. I.A. 1502/2024 has been moved on behalf of petitioner for withdrawal of the present petition i.e. O.M.P. (COMM) 183/2023.

Learned counsels for both the parties have submitted that the matter has reached to an amicable settlement. It has further been submitted that the amount deposited by the petitioner in compliance of the order dated 04.12.2023 in the form of FDR No.17596503 dated 15.12.2023 of Rs.3,10,06,782/- be released in favour of the three respondents in equal share. It has been submitted that all the disputes/claims have been mutually settled amongst the parties except FIR No.535/2020 registered at PS Shahbad Dairy, dated 16.10.2020.

In view of the submissions made, the petition bearing O.M.P. (COMM) 183/2023 is dismissed as withdrawn. The parties are held bound by the settlement.

The amount deposited with the learned Registrar General of this court be released to the respondents in equal share with the interest accrued thereon. The amount may be transferred to the bank accounts of the respondents as provided by the learned counsel for the respondents, details of which are as under:
