% 19.06.2020 CM No.12962/2020 (Exemption) This application has been filed seeking exemption from filing duly certified/typed/true copies of annexure to the petition and notarised affidavits and affixing requisite court fee. Binding the deponent of the affidavit to the contents of the application, the exemption is granted. Application is disposed of.

This petition has been filed by the petitioner complaining that the wife of the petitioner expired due to Covid-19 on 14.06.2020. The daughter of the petitioner who is aged about 34 years and is 85% permanent disable, started suffering from fever and breathlessness and as her condition aggravated having low oxygen level with breathing issues and high fever, she was admitted to the Primus Super Speciality Hospital, Chankyapuri,

New Delhi on 18.06.2020. It was suspected that she was also suffering from Covid-19 virus but the hospital did not carry out any test on her and in fact, taking an excuse that there was non-availability of beds, asked the petitioner to shift her to another hospital. In fact, she was almost thrown out of the hospital. It is submitted that this was in spite of the fact that the website of the respondent no.1 shows availability of the beds in the said hospital for the Covid-19 patients.

After filing of the present petition, the petitioner has been able to secure the admission of his daughter to Max Super Speciality Hospital, Saket, New Delhi.

The learned counsel for the petitioner submits that though the daughter of the petitioner has been admitted to the hospital, the hospital is yet to carry out the test on the petitioner as also his son. As they had also come into the contact of the wife and daughter of the petitioner, it is apprehended that they may have also contacted the Covid-19 virus. 4.

In view of the submissions made, the learned counsel for the respondent no.1 fairly submits that he will request the concerned authority to immediately carry out the test on the petitioner as also his son. 5.

As the allegations made by the petitioner against the Primus Super Speciality Hospital, Chankyapuri, New Delhi are of a grave nature, the respondent no.1 is directed to carry out an investigation into the same and in case the hospital is found to have derogated in its duty in any manner, take appropriate action in this regard. I may, however, clarify that this Court has not expressed any opinion on the allegations so made by the petitioner. 6.

The petition is disposed of with the above directions.
