By way of the present petitions filed under sections 29A(4) & 5 of the Arbitration & Conciliation Act 1996 ('A&C Act'), the petitioner seeks extension of the mandate of learned Sole Arbitrator, who is seized of the disputes between the parties, by 03 months. 2.

Mr. Arunal Tewari, learned counsel appearing for the petitioner submits, that the learned Sole Arbitrator was appointed vide orders dated 19.01.2021 made in ARB.P Nos. 478/2010, 481/2010 and 482/2010. Thereafter a consensual extension of mandate was granted for 06 months, as recorded in orders dated 01.03.2023 passed by the learned Sole Arbitrator in the 03 matters.

Mr. Tewari submits, that subsequently, vide order dated 17.11.2023 passed by a Co-ordinate Bench of this court in O.M.P.(MISC.)(COMM.) 531/2023 and connected matters, a further extension of 06 months was granted w.e.f. 14.09.2023, which ran-out on 14.03.2024.

Upon being queried, Mr. Tewari informs the court that the proceedings before the learned Arbitrator stand concluded and award has been reserved. However, by reason of a fire in the office premises of the learned Arbitrator, there is some delay in pronouncing the award.

Issue notice.

Ms. Aashana Bhatia, learned counsel appears on behalf of the respondents on advance copy; accepts notice; and does not oppose the prayer made.

Accordingly, the petition is allowed, thereby extending the mandate of the learned Sole Arbitrator by a period of 03 months with effect The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

from today, while also observing that any arbitral proceedings carriedon after the expiration of the last mandate shall also stand validated and regularised.

The learned Sole Arbitrator is requested to pronounce the award within the extended period of mandate.
