The Petition under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the Petitioner for quashing of FIR No.736/2015 dated 11.06.2015 under Section 354-D/509/506/34 IPC registered at Police Station Burari, in terms of Memorandum of Settlement dated 22.07.2024. 2.

As per the allegations in the FIR, there were some labour employed for construction in the adjoining house of Respondent No.2, who used to make sarcastic remarks "cheetakashi" on the Respondent No.2. When the Complainant/Respondent No.2 approached the owner of the house, he fought with the Complainant. Consequently, the FIR got registered. It is submitted that the Chargesheet was filed in the Court and during the pendency of the case, the Petitioners and Respondent No.2 with the intervention of respectable community elders and well-wishers have sorted out their all differences vide Settlement Deed dated 22.07.2024 and they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed. 4.

The complainant is present in the Court and submits that the matter stands settled with the Petitioner, who has filed the present Petition. The Complainant has no objection if the FIR is quashed against the Petitioner on account of the settlement already arrived at between the parties. 5.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 6.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 736/2015 dated 11.06.2015 registered at Police Station Burari, for offences punishable under Sections 354D/509/506/34 of the Indian Penal Code, 1860 with all the subsequent proceedings and the charge sheet is hereby quashed qua the Petitioners. 7.

The Petition stands disposed of accordingly along with the pending Application(s).
