The hearing has been conducted through Video Conferencing. 2.

By this petition, the petitioner seeks interim bail in case FIR No.430/2018 under Sections 302/34/120-B IPC and Sections 25 & 27 of the Arms Act registered at P.S. Bawana on the ground that the petitioner has to perform the last rites and rituals of his deceased father. 3.

A status report has been filed verifying the fact that the father of the petitioner expired on 9th June, 2020 4.

The petitioner had applied for interim bail before the learned Trial Court which granted permission to the petitioner to go in custody on 22nd June, 2020 to perform Tehrvi ceremony.

According to the learned counsel for the petitioner, the petitioner being the eldest son, has to do Asthi Visarjan. 6.

A perusal of the petition reveals that the petitioner has a younger brother and a sister. This fact also stands verified as stated by the learned BAIL APPLN. 1365/2020

Considering the fact that the petitioner has a younger brother who can perform the Asthi Visarjan and the allegations against the petitioner are of entering into a conspiracy and also being present in a car being driven by the petitioner when the deceased was murdered by gun shot and the prosecution witnesses yet to be examined, this Court finds no ground to grant interim bail to the petitioner.

Petition is dismissed.
