By virtue of the present application, the petitioner seeks condonation of a delay of 14 days in re-filing of the present petition. 2.
For the reasons stated in the present application, the same is allowed and the delay of 14 days in re-filing of the present petition is condoned. 3.
As such, the application is disposed of.

the Constitution of India, the petitioner seeks to challenge the order dated 26.09.2025 passed by the learned Chief Judicial Magistrate, South-East District, Saket Courts, New Delhi (learned Trial Court) in Cr. CASES 2668/2023.

At the outset, learned ASC for the State submits that the petitioner has concealed that the very same petitioner has filed another petition being W.P.(Crl.) 221/2026 challenging the very same order dated 26.09.2025 passed by the learned Trial Court in Cr. CASES 2668/2023 which is pending before this Court and is next listed on 22.05.2026. He also submits that despite thereto the petitioner has been falsely stated in paragraph no.38 of the present petition is that "... ... ...no similar or such petition has earlier been filed before this Hon'ble Court or before the Hon'ble Supreme Court of India.".

In response thereto, the petitioner, who is present in person, though admits that an earlier petition was filed, however, states that the same has been withdrawn.

At this stage, the petitioner apologises for his conduct, and he along with learned counsel for the petitioner seeks to withdraw the present petition.

Accordingly, the present petition, alongwith the pending application, is dismissed as withdrawn.
