W.P.(C) 3657/2020 Petitioner in person has preferred this Public Interest Litigation with the following prayers:
"a) Issue an appropriate writ, order and/or direction in the nature of 'Mandamus' thereby directing , the release of under trial prisoners facing trial under section 304B IPC on the same terms and condition on which the under trial prisoners facing trial u/s 304 IPC are being considered to be released on interim
ball in terms of Minutes of meeting dated 18.05.2020 of the High Powered Committee;
b) lssue an appropriate writ, order and/or direction in the nature of 'Mandamus' thereby directing the release of those under trial prisoners who are facing trial under section 304B and have spent one year in jail and are not involved in any other offence;
c) Issue an appropriate writ, order and/or direction in the nature of 'Mandamus' thereby directing the High powered Committee to consider the under trial prisoners facing trial under section 304B IPC to be put in the category of prisoners who can be considered to be released on interim ball; d) Pass such other or further order/orders as this Hon'ble Court may deem fit in the larger interest of justice." It is submitted by the petitioner in person that the grievances ventilated in this petition have been brought to an end vide a joint meeting held on 20.06.2020 between the Jail Authority and the Delhi State Legal Services Authority.
Learned counsel appearing for respondent No.1 submitted that taking into consideration letter dated 13th June, 2020 by Director General (Prisons) the aforesaid joint meeting was held on 20.06.2020, wherein, it has been decided that the under trial prisons who are related as spouse of the deceased, facing trial of a case under Sections 498A and 304B of IPC, and are in jail for more than two years with no involvement in any other case shall be considered for grant of interim bail for 45 days preferably on personal bond. Similarly, in the case of father-in-law, mother-in-law, brothers-in-law and sisters-in-law of the deceased, the above consideration for interim bail shall be made in cases where the accused is in jail for more than one year.
In view of the aforesaid submissions, the grievances in this petition
have been brought to an end, hence this writ petition is disposed of. CHIEF JUSTICE PRATEEK JALAN, J JUNE 22, 2020 ns
