No. 13071/2020 (Exemption from filing certified copies and original documents) In view of the reasons stated in the application, the same is disposed of with a direction to the applicant to file the certified copies and original documents within a period of one week of lifting of the lockdown. Application stands disposed of.
W.P. (C) 3659/2020 Hearing has been conducted through Video Conferencing. The petitioner was working as a temporary employee with East Delhi Municipal Corporation. Vide order dated 30.09.2014, the services of the Petitioner were regularized and he was brought into regular pay scale of Rs. 4440/- - 7440/-.
The grievance of the Petitioner is that despite having been regularized in 2014, his salary in the regular pay scale has not been released and he is being paid wages of a temporary employee. The Petitioner has also made several oral requests to the Respondents, but to no avail. Petitioner has sent a representation dated 04.01.2020 to the Respondents, requesting for release of his salary and other allowances in the regular scale, after giving the benefit of the Pay Commissions.
Ms. Roopa Nagpal, learned counsel appearing for the Petitioner submits that even the representation is pending since January, 2020 and neither have the respondents responded to the representation nor released his salary.
The limited prayer in the present writ petition is for a direction to the Respondents to dispose of the representation. Issue notice.
Mr. Harish Khinchi accepts notice on behalf of the Respondents and seeks a period of six weeks from today to dispose of the representation of the Petitioner and assures the Court that the needful will be done within six weeks.
Petition is accordingly disposed of with the direction to the Respondents to dispose of the representation of the Petitioner dated 04.01.2020, within six weeks from today.
The order passed will be communicated to the Petitioner within a period of one week thereafter.
Needless to state that if any grievance survives after the disposal of the representation, Petitioner will be at liberty to take recourse to appropriate remedies available to him in law. Respondents will also communicate to the
Petitioner detailed calculation of the amounts due to the petitioner towards the revised salary and the arrears.
