At the outset, learned Counsel for the Respondent raises an objection on the maintainability of the present Petition. She submits that the present Petition is not maintainable in view of the proviso to Section 115 of the Code of Civil Procedure, 1908.

Learned Senior Counsel for the Petitioner, on instructions, seeks permission of the Court to withdraw the present Petition with liberty to file an appropriate Petition in accordance with law. Liberty as sought for is so granted.

The Petition is accordingly dismissed as withdrawn. All pending Applications stand closed.
