On April 23, 2019, this Court had noted the submission made by
Mr. Rajiv Kapur, Adv. for the petitioner that he would be satisfied if the Ld. CMM is directed to dispose of the applications under Section 340 Cr.P.C. filed by the respondents; the application for stay of the proceedings by the respondents and the Bank's application for appointment of a Bank Officer as a Court Receiver.
Mr. Nayar is agreeable to the submission made by Mr. Kapur. I have been informed that the next date of hearing before the Ld.CMM is May 10, 2019. Accordingly, this Court directs that the learned CMM shall hear all the three applications and decide the same as expeditiously as possible but on or before May 31, 2019, as an outer limit. The petition stands disposed of.
