% 22.06.2020 Crl.M.A No. 8036/2020 Exemption allowed, subject to all just exceptions. Bail Appln. No. 1368/2020 The applicant vide the present Bail Appln. No. 1368/2020 seeks grant of interim bail during the present pandemic period in relation to FIR No. 32/2019, Police Station Prasad Nagar, registered under Sections 302/323/341/147/148/149 of the Indian Penal Code, 1860 submitting inter alia to the effect that the applicant is 26 years old and seeks interim bail till the date 30.9.2020 in view of the present danger to his life in view of the prevailing pandemic.
Learned APP for the State has opposed the prayer for interim bail and seeks time to submit a status report submitting inter alia to the effect that there were multiple stab injuries that were sustained by the deceased. It is considered essential to observe that the prayer that has been made for release on interim bail by the applicant due to present pandemic cannot
be granted taking into account the factum as rightly held vide order dated 11.6.2020 of the learned Additional Sessions Judge-03 Central, Tis Hazari Courts, Delhi that the applicant does not fulfil the criteria as laid down by the Hon'ble High Powered Committee of this Court vide Minutes dated 18.5.2020 at serial No.6 in as much as the period of incarceration of the applicant is not yet 2 years from the date of incarceration of the applicant, i.e., 10.2.2019.
In the circumstances there is no ground for grant of interim bail. The application is dismissed.
