% 23.06.2020 CRL. M.A. 8081/2020 and CRL. M.A. 8082/2020 (exemptions) 1.

Exemptions are allowed, subject to the condition that the petitioner will file the duly sworn/attested affidavit, the certified copy of the annexures and the requisite court fee within 72 hours from the date of resumption of the regular functioning of this Court.

The present application has been filed seeking extension of interim bail granted to the petitioner in FIR No. 65/2015 under Section 18 of NDPS Act, registered at Police Station Special Cell vide order dated 28.02.2020. 2.

Learned counsel for the petitioner submits that the petitioner was granted interim bail for a period of 4 weeks on account of marriage of his daughter. He submits that the petitioner could be released only on 26.05.2020 whereafter he has performed the marriage of his daughter on 14.06.2020.

Learned counsel for the petitioner has referred to the document dated 15.06.2020 issued by the Incident Commander/Block Development Officer and the SHO, Gidhaur to submit that the area around the petitioner's house in village Gidhaur has been declared as a Containment Zone/ Buffer Zone. He submits that on account of the travel restrictions, the petitioner at this point of time is unable to surrender before the concerned Jail Superintendent.

Learned APP for the State has filed the Status Report through email. She submits that it is not the petitioner's village but the adjacent village which has been declared as a Containment Zone/ Buffer Zone. 5.

Learned counsel for the petitioner, on instructions, submits that the villages are neighbouring and the containment zone spreads to about 3 kms. 6.

In the facts and circumstances of the case, the petitioner's bail is extended upto 15.07.2020 on the same terms and conditions. 7.

On expiry of interim bail period, the petitioner shall surrender before the concerned Jail Superintendent.

With the above directions, the application is disposed of. 9.

A copy of this order be communicated to the concerned Jail Superintendent as well as to the concerned I.O/S.I./S.H.O. electronically for information and necessary compliance.
